Article 17 of the Marriage Law stipulates the scope of the property acquired by the husband and wife during the existence of the marital relationship, which should be jointly owned by the husband and wife, that is, the following property acquired by the husband and wife during the existence of the marital relationship shall be jointly owned by the husband and wife:

(1) wages and bonuses refer to the wages, bonuses and various welfare policy income and subsidies of one or both parties during the existence of the relationship between husband and wife.

(2) the income of production and operation refers to the income of one or both husband and wife engaged in production and business during the existence of the relationship between husband and wife.

(3) the income of intellectual property rights refers to the income of intellectual property rights owned by one or both husband and wife during the existence of the relationship between husband and wife.

(4) the property obtained by inheritance or gift refers to the property acquired by one or both parties as a result of inheritance and gift during the existence of the relationship between husband and wife. For the income of inheritance, it refers to the acquisition of property rights, not the actual possession of property. Even if there is no actual possession before the termination of the marriage, as long as the inheritance occurs during the existence of the relationship, the inherited property is the joint property of the husband and wife, except as provided for in paragraph 3 of Article 18 of this Law.

(5) other property that should be jointly owned.

(6) the housing subsidy and housing accumulation fund actually obtained or should be obtained by both parties.

(7) the old-age insurance funds and bankruptcy resettlement compensation actually obtained or should be obtained by both parties.

(8) during the existence of the marital relationship, part of the husband and wife shall share the one-time expenses paid to the servicemen, such as reinstatement fee, independent employment fee and so on.
